Please read the terms and conditions before accessing or using any of the NASH Management services.

Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all employees, guests and others who access or use the service. By accessing or using the service you agree to be bound by these terms. If you do not accept all of these terms then you may not access the service.

Key Points

1. You are responsible for all significant damage that occurs during your reservation and any discernable damage that exists at the beginning of your reservation that you fail to report.

2. At the completion of the reservation, you must ensure that the resource is in clear working order, with an identical or greater level functionality and cleanliness compared to the beginning of the period of use.

3. Children are generally not allowed to use facilities, with the exception of supervised use of the pool area, tennis court, marina or where written consent is provided from The Company.

Definitions

The Company: QuantRes (QR), Market Research Inc., and contracted individuals in administrative roles.

Resource: Any tangible asset belonging to or managed by The Company or its proprietor, Harald McPike. Resources include but are not limited to vehicles, apartments, rooms, facilities/amenities and components thereof.

User: the individual granted a documented, temporary right to utilize one or more resource; the person responsible for the safe usage and return of the resource to The Company.

Period of use: The recorded date range for the booking. This range is primarily recorded in the website / web portal database.

Reservation: A nullifiable contract between the User and The Company to utilize/occupy a particular resource for a limited period of use.

GENERAL TERMS

I. Scope

1. These Terms and Conditions apply to the occupation and use of QR-owned and QR-managed resources. By using these resources, the User agrees to read and accept the Terms and Conditions presented here. By using the NASH Management Portal, the User also accepts the conditions set out in the Privacy Policy.

2. The User’s own Terms and Conditions shall only apply if they have previously been expressly agreed in writing. A copy of these terms must be included in the User’s document list or linked to on the User’s profile page on the web portal.

3. Breach of this contract may result in legal action.

II. Late or Delayed Usage

If a User does not utilize the resource booked in the reservation within a reasonable amount of time (12 hours for rooms or apartments, 1 hour for vehicles or facilities), the reservation will be considered cancelled and the resource will be made available to other Users.

III. Reservation Limitation

With the exception of recurring reservations for trainers and staff members, resources should not be booked for dates that are more than two months in the future. This rule will decrease the likeliness of overlapping and cancelled bookings, allowing QR employees to create reservations that conform to the QR Company schedule.

IV. Cancellations

1. The User has the right to cancel any reservation without penalty.

2. NASH/QR administrators reserve the right to cancel any reservation due to objectively justified reasons. Typically, cancellations will occur when maintenance is required, or when a higher priority booking must be scheduled. The User will receive a notification of this cancellation. However, it is the User’s responsibility to ensure that the original booking is still valid prior to use of the resource. The User will have no right to claims or compensation when a booking is cancelled.

V. Limitation of Liability

By using the Company’s resources, the User waives the right for liability against The Company. Specifically, The Company will not be held accountable for loss, destruction or theft of the User’s tangible assets, injury of life, body or health. Compensation, if any, will be provided at the discretion of The Company. To allow the possibility of procuring compensation, the User must report the claim to The Company in writing upon knowledge of loss, destruction or damage.

VI. Forgotten or Lost Items

Items left in or on company resources will be temporarily made available to the User. Smaller items will be available for collection up to 30 days after the end of the reservation via the Lost and Found section of the website or by contacting an administrative assistant and filing a claim in writing. Large items will be disposed of, repurposed or sold at the discretion of the administrative team unless the User contacts the Property Manager within 24 hours of the end of the reservation to make immediate arrangements.

VII. Commercial Use

Usage of company resources for commercial purposes is strictly prohibited.

VIII. Damage and Accountability

The User is responsible for damage to resources not resulting from normal wear and tear, or a lack of due diligence on the part of the Company.

APARTMENTS & ROOMS

I. Confirmation of Availability

As is stated in the general terms, it is the User’s responsibility to confirm the availability of a reserved room or apartment prior to their arrival.

II. Subletting

Subletting and re-letting of the rooms as well as the use of the resource for any other purpose than accommodation is strictly prohibited.

III. Pets

Pets are generally prohibited. The User must request permission to keep a pet in writing to property@nashwwltd.com. The request must include provisions for controlling noise, waste and pests. Permission is continuously dependent on the behavior of the pet and the level of conscientiousness and responsibility displayed by the owner.

IV. Housekeeping

Complimentary cleaning services at apartments in the NASH complex are offered on a weekly basis. For short-term reservations, Users may request that cleaning is not completed during their stay. On the other hand, if additional, immediate cleaning is required, the User must request it using the Service Request Form on the web portal.

Cleaning services may not be available at non-NASH QR-managed properties.

V. Returning the Room/Apartment

At the end of the reservation, the User is expected to vacate the room or apartment to allow for cleaning and occupation by other Users. Any changes to the User’s schedule must be reported to The Company immediately. The User acknowledges that there is no guarantee that changes in their schedule can be accommodated.

Issues relating to the apartments can be reported on the “Report an Issue” section under Maintenance.

FACILITIES

NASH/QR facilities, include the cinema room, entertainment room, gym, Pilate’s room, pool area, sundeck, Jet Ski, tennis court, kayak, paddle board, Ski Nautique, eFoil at the NASH complex. The list of available resources is subject to change without notification. Usage/operation of these facilities is undertaken out at the User’s own risk. Further, it is the User’s responsibility to obtain proper instruction prior to using any facility property@nashwwltd.com. The User releases QR from any possible liability.

At the completion of the reservation, the User must ensure that the facility is in clear working order, with an identical or greater level functionality and cleanliness compared to the beginning of the period of use. Online service/maintenance requests can be created for facilities if cleaning is needed or if the User finds that a device or feature is malfunctioning.


VEHICLES

I. Usage Restrictions

The User must not:

1. allow the vehicle to be used outside his/her authority.

2. operate the vehicle or allow it to be operated in circumstances that constitute an offence according to the laws set forth by the Road Traffic Department of The Bahamas.

3. operate the vehicle while under the influence of alcohol, any psychoactive drug, or in any state of altered/impaired consciousness.

4. drive or allow the vehicle to be driven by any person if at the time of driving the vehicle the driver does not hold a current full valid driver's license.

5. allow the vehicle to be driven by any person who is not named or described in the reservation form for the vehicle.

6. transport any animal in the vehicle without prior written consent.

7. allow any person to eat or smoke in the vehicle.

8. operate the vehicle or allow it to be operated in a manner that may cause damage to the vehicle. This includes but is not limited to (a) transporting goods beyond the maximum loading weight for the vehicle; (b) being driven on a roadway that is unpaved or any surface otherwise unfit for use. (c) Using the vehicle to propel or tow any other vehicle.

9. return the vehicle in a state of disorder or uncleanliness.

II. User’s Obligations

The User must ensure that:

1. all reasonable care is taken when driving and parking the vehicle.

2. only the fuel type specified for the vehicle will be used.

3. the tires are maintained at their proper pressure.

4. the water in the vehicle's radiator, the oil level and battery are maintained at the proper level. Should a warning light be illuminated or the User believes the vehicle requires mechanical attention, the User will advise the Company immediately.

5. the vehicle is locked and secure at all times when it is not in use and the keys kept under the User’s personal control.

6. all drivers allowed to operate the vehicle during the period of use are aware of and comply with the terms outlined in this document.

7. any driver carries their driver's license with them in the vehicle at all times and will produce it on demand to any law enforcement officer.

III. Mechanical Repairs, Accidents & Roadside Assistance

1. If the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the User must notify the Company of the full circumstances by telephone immediately. An emergency contact card is provided in the glove compartment.

2. The User must not arrange or undertake any repairs or salvage without the Company’s authority (this includes, but is not limited to, purchasing a replacement tire) except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property.

IV. Liability

The User is liable for:

1. any loss of, or damage to the vehicle and its accessories not covered by the insurance policy

2. any loss of, or damage to, vehicles and property of third parties, arising during the period of use not covered by the insurance policy

3. any penalties related to traffic or parking violations arising during the period of use

V. Parking

The User hereby acknowledges that the Company is in no way responsible for damages or loss of value to personal vehicles or items stored on the premises of the NASH complex or the property of any other company-managed resources.

VI. Fuel

The Company provides refueling for vehicles when they are used for short personal trips or Company-related trips. To avoid emergencies and possible damage to the vehicle, it is requested that Users return vehicles with a sufficient amount of fuel to permit further use. The User is responsible for checking the fuel level at the beginning of the period of use. The Company will provide compensation if the User refuels the vehicle during the course of a short or Company-related trip. Requests for compensation must be made in writing and must include the relevant receipt(s)


SITE PRIVACY POLICY

Data collected during the course of creating a reservation or maintaining User information will be stored on the Company’s local computer(s) and/or remote server(s). Your information may be shared with internal departments to allow for maintenance, accounting or to improve some aspects of a future stay. Your details with not be shared with any third party unless they are a direct affiliate of the Company involved in management, maintenance or service tasks.
